- These Terms and Conditions were updated on 12/07/2009 and prevail any previous versions of our Terms. By logging in and using our website, you thereby agree to and are bound by these Terms and Conditions.
- SpecialGifts2India.com is a service provider which facilitates orders between you (the User) and our vast variety of vendors associated with us. SpecialGifts2India.com, its officials and employees shall not be held responsible for any losses, expenses, quality of products or services, damages and/or taxes incurred by the Users / Vendors in the use of the facility.
- The price you (The User) pay, is inclusive of the price charged by the Vendor and the service charge for using our facility. We reserve the right to alter these prices at any time, without any prior notice.
- Any complaints with the gifts received should be reported within 24 hours. Any issues reported after that wil not be entertained and the gifts will be assumed to have been used by that time.
- In case of exchange / return of any non-perishable gift item, the costs of courier, if any, would be bourne by you (The User).
- Your occasions are important to us and hence we provide you with a facility to provide a delivery date associated with the order. For cakes and flowers, for every occassion, we will use the FIFO principle. This means that if an order is received very close to the requested date of delivery, we may have to push your order and deliver it on a following day. SpecialGifts2India shall not be held responsible in such circumstances. For all other gifts which need to be couriered, once the gift is sent to the courier company, it is not possible to have it delivered on a specific requested date. Again, SpecialGifts2India shall not be held responsible for such deliveries.
- Each gift can be delivered to selected set of Cities / Towns within India. It is your (The User's) responsibility to make sure a gift can be delivered to the requested City prior to placing the order.
- Request for cancellations of orders once placed on SpecialGifts2India.com shall not be entertained.
- We reserve the right to cancel any order without providing any reason. This will be regardless of whether the payment has been confirmed / received. Payment for the canceled orders will be refunded and the user will be informed. Refund can sometimes take up-to 31 days to take effect.
- In the case of a failed order caused due to the mistake / negligence of the user, any costs associated with the redelivery of the order will be borne by the User.
- Any information provided by the User must be accurate. SpecialGifts2India reserves the right to verify this information and in-case an inaccuracy is detected, SpecialGifts2India.com has the right to reject the registration of the User and ban the User from future usage of the services provided by SpecialGifts2India.
- You (The User), while placing an order must use your own Credit Card. SpecialGifts2India.com will not be liable for any kind of credit card fraud. The liability of using a fraudulent credit card lies on the user and the responsibility to establish otherwise shall exclusively be the users.
- SpecialGifts2India.com shall not be liable for any delay/non-delivery of ordered goods by the vendors (trade organizations, manufacturers / shops etc.) caused by flood, fire, wars, acts of God or any other reason that is beyond the control of SpecialGifts2India.com and its vendors.
- The User agrees to use the services provided by SpecialGifts2India.com, its affiliates, consultants and contracted companies, for lawful purposes only.
- You (The User) asserts that you are at least 18 (eighteen) years of age or have the consent of a parent or legal guardian.
- All pictures for flowers, cakes and other perishabe items are indicative in nature. Our vendors will make every effort but the actual arrangement could vary due to variability of flowers and cakes across different destinations. SpecialGifts2India.com or any of its Vendors shall not be held responsible and we reserve the right to reject any complaints in regards to this matter.
- All deliveries are done during the day time between 8 AM to 8 PM. If you have mentioned a specific time of delivery above, we will try our level best to follow the same. Products which are couriered can only be delivered at a residence or a business address, they can not be delivered to a wedding hall or a function hall. Products which are delivered by hand, can be delivered to any address given by you. Midnight orders are delivered between 23:45 Hrs to 00:15 Hrs.
- All products and services provided by SpecialGifts2India are provided on an "as is" basis at the User’s sole risk, without warranties of any kind, whether express or implied. Warranties if at all indicated, shall take place between the vendors and the User and SpecialGifts2India will not play any role and should not be responsible in disputes or any queries pertaining to the same.
- Specific instructions related to the type of delivery associated with each product is available on the Product details page. You (The User) is advised to carefully read the notes prior to placing an order.
